The meeting of President Joko Widodo at the Palace with the Chairman of Indonesia Solidarity Party Grace Natalie and friends becomes a prolonged problem.

Many criticize the meeting. One of them is the Central Board Chief of Prosperous Justice Party (PKS) Mardani Ali Sera.
“President offside. Should not use state facilities for practical political interests “, Said Mardani Ali Sera.

Then there was Vice Chairman of the House of Representatives Fadli Zon who also expressed his opinion. Next there is an Indonesian Institute of Sciences (LIPI) Observer Siti Zuhro who said the President must keep political ethics.

And the most recent Advokat Cinta Tanah Air (ACTA) which complained the meeting to the Ombudsman.

President Has the Right to Meet Anyone

It seems some people do not understand the position of a President. The President may accept anyone in the Palace or elsewhere, regardless of group. The President is not a candidate of a particular party as at the time of the campaign. Once elected, a President is not only the President of the person who elects him, but the President for all (the people of Indonesia).

The Critics of the meeting saw Grace Natalie as a former journalist and newscaster on a television station. They do not realize that Grace Natalie is no different from Megawati, Susilo Bambang Yudhoyono, Surya Paloh or Prabowo Subianto. They have the same status as a party chairman who will officially compete in the upcoming elections.

Perhaps some people have forgotten, or may have another point of view, that when President Joko Widodo meets with Megawati and Susilo Bambang Yudhoyono, they consider him as a former President. We never know what’s in Jokowi’s mind. It could be in the meeting Jokowi positioned the two person mentioned above as a chairman of a party, not as a former President.

What is the Ombudsman? And What Is The Function?




What exactly is the Ombudsman?

The Ombudsman is a State Institution with Authority to Conduct Oversight of Public Service Implementation throughout Indonesia.

Its function is to oversee the implementation of the Public Service held by the State Organizer and the Government, both central and regional, including those held by State-Owned Enterprises as well as Private or Private bodies assigned to perform certain public services.

The tasks are:

1. Receiving reports on alleged Maladministration in the implementation of Public Services
2. Conduct a substantial examination of the Report
3. Follow up Reports covered within the scope of ombudsman authority
4. Investigate on its own initiative against alleged Maladministration in Public Service delivery
5. Coordinate and cooperate with State institutions or other government agencies as well as community and private institutions
6. Build networking
7. Prevent Maladministration in Public Service Provision and
8. Perform other tasks provided by the Act.

The problem that arose was that the meeting of the President with the leadership of the Indonesian Solidarity Party was disputed by several parties. If we look at the duties and functions of the Ombudsman above and try to make a correlation with the meeting at the Palace there seems to be no maladministration in it. Or it may be said the report to the Ombudsman is “address wrong”, because the Palace or the Presidential Office is not a public service area!

While the ACTA report is based on Laws of Republic of Indonesia No. 37/2008 (UU NO. 37/2008), Article 1 number 3 which reads:

Maladministration is a behavior or act unlawfully, transcends authority, uses authority for any other purpose of the purpose of such authority, including negligence or neglect of legal obligations in the administration of public services carried out by the State Organizer and the government causing material and / or immaterial harm to the public and individuals.

If the President is deemed negligent or disregarding obligations in the provision of public services or using state facilities, then where the President should receive his guests? Even “youtuber” had visited the Palace, not to the residence of President Jokowi.




Closing

Anyone can support the President. And anyone can disagree with the President. Just as the President can meet with anyone. Even with a political opponent. And to let us know maybe only President Joko Widodo who did it. The previous president did not meet his political opponents at the Palace, not even at all. Jokowi did so with his rival in the 2014 Presidential Election Prabowo Subianto.

Maybe there will be another party chairman who will visit the Palace, to meet Jokowi.

Or if the critics were invited to the Palace, does that mean they do not want to come because using state facilities?
